Rules for Come Clean 4 Congo Video Contest

Eligibility
Come Clean 4 Congo video contest (the "Contest") is only open to contestants who are U.S. residents and 18 years or older at the time of submission. Void outside the 50 United States and the District of Columbia. The Contest is void where prohibited by law. Additionally, the following individuals are not eligible to enter the Contest: employees, consultants, directors and officers of the Contest Sponsor, Google, Inc., YouTube, LLC, and each of their respective parent, subsidiary and affiliated companies, (collectively, "Contest Parties"), and the immediate family members. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
Previous video-making experience is neither required nor prohibited.
Contest Sponsor and Administrator
Center for American Progress/Enough Project, which is located at 1225 Eye St., NW, Washington, D.C. 20005, is the sponsor and administrator of the Contest ("Sponsor"). YouTube is not a sponsor of the Contest and has no responsibility or liability regarding the conduct or administration of the Contest.
Agreement to Official Rules
Participation in this Contest constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's and judges' decisions, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein. Timing The Contest begins on May 18, 2009 at 12:00:01 a.m. Eastern Summer Time ("EST"), ends on September 8, 2009 at 11:59:59 p.m. EST (the "Contest Period") and consists of three (3) phases as set forth in the chart below. Sponsor's computer is the official time-keeping device for the Contest.

General Requirements
Video Submissions:
- must include a cell phone in some creative way, and include our call to action - text "CONGOPLEDGE" (one word, no spaces) to ACTION (228466)
- must not be more than one minute in length, including titles.
- may use any narrative and technical style, including documentary, fiction, live action or animation.
- must be in English or have English subtitles.
- must be uploaded to the YouTube Enough Project Contest site at www.youtube.com/enoughproject (the "Contest Site") by 11:59:59 p.m. EST July 1, 2009.
Please note: You must have a valid YouTube account and agree to the YouTube Terms of Use, located at http://www.YouTube.com/t/terms, and the YouTube Privacy Policy, located at http://www.youtube.com/t/privacy, in order to be eligible to enter. Registration on YouTube must be completed before a Video can be submitted. Creating a YouTube account is free. Once logged in, follow the links and instructions on the Contest Site to upload a Video.
LIMIT: Each contestant ("Entrant" or "Contestant") may submit only one (a) Video. If any group of individuals elects to collaborate on a Video, they are required to designate one individual to enter the Contest, be responsible for getting necessary signatures from the group for required documentation, and accept the prize on behalf of the group and appear at the Prize Event on behalf of the group. Sponsor is not liable for any disputes between collaborators related to a Video.
Once a video is uploaded to the Contest site it is considered final and may not be modified or edited. Video Submissions will not be returned.
By completing the registration and submitting your Video, you agree that your Video conforms to the Content Guidelines section below as well as the YouTube Terms and Conditions (collectively, the "Guidelines and Restrictions") ("Qualifying Video") and that Sponsor and/or YouTube, in their sole discretion, may remove your Video at any time and for any reason, including if it believes, in its sole discretion, that your Video fails to conform to the Guidelines and Restrictions in any way, fails to conform to the YouTube Terms of Use, or otherwise contains prohibited, inappropriate, offensive, infringing or otherwise unacceptable contest as determined by Sponsor or YouTube, in their sole discretion, in which case your Video shall be disqualified from the Contest.
NOTE: You understand and agree that your Video will be posted online and viewed by other people during and after the Contest. Content Guidelines and Video Ownership and Rights
IMPORTANT: Be sure to save your Video in the original format after uploading it to the Contest Site. If you are a Finalist, you agree that you will provide Sponsor with your Video in its original format in order for the Video to be used in future promotion or other activities.
Content Restrictions:
The Video must meet the following content restrictions:
- The Video must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement;
- The Video must not contain brand names or trademarks;
- The Video must not contain music, photos or artwork not created by entrant (other than the Sponsor Materials provided (see below);
- The Video must not contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous or libelous;
- The Video must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and
- The Video must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Video is created.
Entrants may (but are not required to) download photographs, images and videos ("Sponsor Materials") from the sponsor's special web page and incorporate such materials into his/her video. You agree that you will use the downloaded Sponsor Materials solely in connection with your participation in the Contest.
For all Videos:
By submitting a Video, you warrant and represent that:
(a) it is your original work and has been legally created,
(b) it has not been previously published or distributed in any media,
(c) it has not been entered in or won previous contests or awards,
(d) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity,
(e) that you have obtained permission from any person whose name or likeness or voice is used in the Video and that such person is 18 years of age or older - PERSONS UNDER THE AGE OF 18 MAY NOT APPEAR IN A VIDEO,
(f) you own all rights to your Video, including without limitation, copyrights, and, that you have received prior written permission from the videographer of the Video if the Video entry was taped by someone other than the entrant him/herself;
(g) publication of the Video via various media including Web posting, will not infringe on any third party rights; and
(h) you will indemnify and hold harmless the Contest Parties from any claims and damages (including reasonable attorneys' fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, your Video, or your conduct in creating your Video or otherwise in connection with this Contest.
All Videos will become the exclusive property of Sponsor, and none will be acknowledged or returned. By submitting a Video, entrant irrevocably grants Sponsor and its respective agents an unlimited, worldwide, perpetual, unconditional, gratis license and right to edit, modify, adapt, distribute, stream, post, publish, broadcast, reproduce, encode, store, copy, transmit, publicly display, exhibit, and or otherwise use or reuse (without limitation as to when or to the number of times used) the Video and all elements thereof, in whole or in part, including any persons or likeness embodied therein (in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion) in any way, and may use them in any and all media, now or hereafter devised, worldwide in perpetuity, without attribution, compensation, permission or notification to the Entrant, his/her successors or assigns, or any other entity, and without notice, review, or approval from Entrant or any other party.
Furthermore, although Sponsor is not under any legal or contractual obligation to do so, Sponsor reserve the right to review and/or edit any and all Video elements deemed by Sponsor, in its sole discretion, to be prohibited, inappropriate, offensive, infringing or otherwise unacceptable. Should Sponsor edit any such Video elements, entrant is not relieved from responsibility for compliance with the YouTube Terms of Use and these Official Rules. ENTERING A VIDEO IN THIS CONTEST CONSTITUTES ENTRANT'S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANSFERENCE TO SPONSOR OF ANY AND ALL RIGHT, TITLE AND INTEREST IN THE VIDEO INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS.
Upon Sponsor's request, each contestant must provide a signed written personal release and/or license/ assignment from (1) entrant and all other persons who appear in the Video submitted, and/or (2) the copyright owner of any sculpture, artwork or other copyrighted material that appears in the video entry (including but not limited to depictions of buildings or other structures), authorizing use of the Video in Sponsor's and Sponsor's designees' editorial publications, advertising, marketing and promotions in any and all media now known or hereafter known throughout the world in perpetuity, without additional compensation, permission or notification, unless prohibited by law.
All releases must be in the form provided by Sponsor. Accordingly, Entrants agree to sign all legal forms deemed necessary by Sponsor to establish Sponsor's ownership of the right, title and interest in and to the Video and of the transferred copyrights and "Moral Rights of Authors" waived under these Official Rules. Entrant must provide fully completed documentation within five (5) days of the date notice or attempted notice is sent. Failure to provide such releases upon request may result in disqualification and the entrant whose Video receives the next highest score may be deemed the alternate potential Finalist or winner for the applicable prize.
Contest Parties are not responsible for lost, late, incomplete, invalid, un-intelligible, garbled, delayed, inaccurate or misdirected Videos, Videos not uploaded in accordance with instructions, or Videos not received for any reason; all of which will be disqualified. Sponsor reserves the right to, but is not obligated to, monitor/screen entries prior to posting them to the Contest Site. By entering, you acknowledge that Sponsor has no obligation to use or post your submitted Video. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants.
Additionally, the Video Submissions are hosted by YouTube on the Contest Site, and will be available on any YouTube-hosted Contest page and generally on YouTube, and will continue to be so available following the completion of the Contest.
Judging to Determine Finalists
All eligible Entries received during the Open Call for Entries will be judged by a panel of judges selected and retained by Sponsor, in its sole discretion. This panel will score each eligible Entrant's Submission based on the following criteria: (1) ability to convey relationship between conflict minerals in cell phones and the crisis in Congo; (2) creativity and style; and (3) production quality.
This panel will determine the top three entries, to be known as the potential "Finalists." The judges' decisions are final and binding in all matters relating to this Contest. If Sponsor does not receive a sufficient number of eligible and qualified entries, the number of Finalist Videos for the YouTube member vote may be reduced at the discretion of the Sponsor. Sponsor reserves the right not to select any Finalists none of the Video Submissions meet minimum judging criteria, at Sponsor's sole discretion.
Finalist Notification
The three potential Finalists will be notified by telephone and/or email no later than July 17, 2009. To be eligible to be a Finalist, the entrant must agree to be available to travel to Los Angeles on the scheduled date for the Prize Event (see below). A potential Finalist who is not willing and able to travel to Los Angeles on the specified date the potential Finalist will be disqualified and the next highest scoring Video Submission will move up and be notified as a potential Finalist, time permitting, and at the sole discretion of the Sponsor.
All potential Finalists will be required to sign and properly execute where lawful, an Affidavit of Eligibility, Compliance with the Rules, Assignment and License, Liability and Publicity Release. If any documents sent by any means to a potential Finalist are returned as undeliverable or if a potential Finalist fails to properly execute, notify, and return all documents described herein by July 21, 2009 or another date specified by Sponsor, or if a potential Finalist is found not to be eligible or not in compliance with these Official Rules and the YouTube Terms of Use or Community Guidelines, the potential Finalist will be disqualified and the next highest scoring Video Submission will move up and be notified, time permitting, and at the sole discretion of the Sponsor. Such substitute Finalist will have 5 days to properly execute and return all documents described herein.
Member Voting
The Finalists' Videos will be posted on the Contest Site for member voting, beginning on or about July 23, 2009 and ending at 11:59:59 PM (EST) on September 8, 2009 (the "Member Voting Period"). Using the YouTube Voting Tool, registered YouTube members will have the opportunity to rank (1 through 3 with 1 being the highest ranking) the Finalist Videos during the Member Voting period. Instructions for using the Voting Tool will be provided. There is a LIMIT of one Voting Tool use per registered YouTube member account per hour during the Member Voting Period. At the conclusion of the Member Voting Period the votes will be tabulated by the Sponsor. The Finalist with the highest vote total will win the Grand Prize (defined below). In the event of a tie at any level, all tied entries will be re-judged by an additional judge selected by Sponsor, who, using the judging criteria detailed in the previous section, will break the tie.
The Grand Prize winner will be announced on Sponsor's website www.enoughproject.org and on the Contest Site www.youtube.com/enoughproject on or about October 15, 2009.
Grand Prize
Round trip transportation to Los Angeles for Winner and a guest (by means elected by Sponsor), one (1) night hotel stay (one room, double occupancy) for Winner and his/her guest on a designated date in October 2009 to appear at a press conference and other events (the "Prize Event") at the discretion of Sponsor. Total estimated retail value of the Grand Prize is $2500. The Grand Prize is non-transferable; no substitutions or cash awards allowed, except at the sole discretion of the Sponsor, in which case a prize of equal or greater value may be awarded. Grand Prize Winner and his/her guest are responsible for all other costs/fees/expenses associated with the trip, including but not limited to meals, tips, ground transportation, insurance, etc. All details of any prize not specified herein shall be determined solely by the Sponsor.
Grand Prize winner's guest must be over eighteen (18) years of age at time of travel or traveling with a parent, and must execute a Liability Release, and, where legal, a Publicity Release prior to the issuance of travel documents.
Taxes
Any valuation of prize(s) stated above is based on available information and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize that are not specifically provided for in the Official Rules. Each winner must provide Sponsor with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
Publicity
By participating, where allowed by law, all participants and winner(s) grant the Contest Sponsor exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use.
LIMITATIONS OF LIABILITY AND RELEASE
The Sponsor and Contest Parties:
- disclaim all liability for the inability of a participant to complete or continue an entry or submission of an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond our control, or otherwise. For all contests, we disclaim all liability for any delays, misdelivery, loss, or failure in the delivery of any item. We are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online Entrant's ability to participate in the Contest, and any injury or damage to an Entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.
- are not liable in the event that any portion of the Contest is cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a "Force Majeure Event"). Should a Force Majeure Event occur, st Sponsors may, but are not obligated to, exercise reasonable efforts to air the winning videos and deliver all or part of the prize or make a reasonable substitution in their sole discretion.
By participating in the Contest, each Entrant waives any and all claims of liability against the Sponsor and Contest Parties, their employees and agents for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from participation in the Prize Event and any travel in connection therewith. In order to receive any prize, the winner(s) must sign an official waiver or release and other documentation provided by Sponsor.
Privacy
Any personally identifiable information that you submit to the Contest Site will used and collected in accordance with Sponsor's privacy policy (not YouTube's privacy policy). Any personally identifiable information that you submit in connection with your registration for membership for the YouTube site itself (www.youtube.com) will be used and collected in accordance with YouTube's privacy policy.
Disputes and Jurisdiction
Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a Court of the District of Columbia.
NOTICE TO ONLINE ENTRANTS: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for faulty, incorrect or mistranscribed phone transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor reserves the right to cancel or modify the Contest if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/judging agency/administrator, in their sole discretion. If technical malfunctions or suspect voting/irregularities corrupt the voting process, Sponsor reserves the right, in its sole discretion, to award prizes based solely on the Finalist judging scores or non-suspect votes. In the event of termination, a notice will be posted online and entries will be judged from among all eligible entries received prior to termination. Any damage made to the Contest Site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods/votes of participation/voting will void all such submissions/votes by such methods. Sponsor reserves the right to prohibit the participation/voting of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
